Srinagar, Jan 12: Government on Friday said that inclusion of five years of ReTs in service was a sub-judice matter.

Replying to a question of MLA Mumtaz Ahmad, the minister Incharge Education said:”Yes sir, it is a fact that vide government order No. 469 Edu of 2014 dated 25/06/2014, it was ordered that five year service rendered by an ReT before regularization shall count for the purpose of fixing their seniority and counting such service, notionally for pensioner and other retrial benefits wherever applicable.”

The minister according to GNS said the government order was challenged by some general line teachers before the high court in SWP No. 1388/2014 titled Anwar Hussain Wani and others v/s state and others, which was dismissed by the court vide its judgement dated 31/12/2014 passed in the matter.

However, the minister said, the judgement has been challenged by the General Line teachers Forum in LPA no. 18 of 2015 and the court vide order dated 24/02/2015 has stayed the judgement dated 31/12/2014.  (GNS)
