Bhim urges Home Minister to remove constitutional barriers imposed by earlier J&K Govts. 

Jammu, Jan 04:         Prof.Bhim Singh, Chief Patron of J&K National Panthers Party & Sr. Executive Member of Supreme Court Bar Association urged J&K Governor to exercise his constitutional power to amend the anti-democratic law which was introduced by J&K Govt. on delimitation of Assembly constituencies in the state till 2016. He said that this freeze imposed by J&K Govt. was totally illegal, unconstitutional and violates the fundamental rights of the people of J&K.

Prof.Bhim Singh said that the Governor is competent to issue an appropriate Ordinance in this regard declaring the Delimitation Law in J&K has not appropriate as it violates the fundamental rights of the citizens of India in J&K. Prof.Bhim Singh said that Govt. of J&K froze Delimitation Act in J&K till 2026. Prof.Bhim Singh said that this Law to freeze on delimitation in J&K till 2026 was imposed at a time when the Govt. of India had imposed such a law in 1976/77 extending the life of Lok Sabha to six years. This law was removed by the Janata Party government in 1977. J&K Govt. did not follow the Parliament and continued the amended law which had extended the life of Assembly to six years and delimitation upto 2026. This was violation of the Constitution of India and even the Constitution of J&K which have provided that delimitation of the constituencies shall be done after every 10 years say after every census. J&K failed to follow the Constitution of India and continues on its own law that there shall be no delimitation till 2026.

Prof.Bhim Singh urged the Home Minister of India to consider this situation and hold delimitation of the Assembly constituencies as has been done throughout the country. No delimitation of the constituencies has been done since 1995. This has also deprived the Scheduled Tribes in J&K (Gujjars, Bakerwals and Gaddies) of reservation in the Assembly after Scheduled Tribes was declared by Prime Minister Shri Chander Shekhar and was entitled for reservation in J&K like SC community in the state. Prof.Bhim Singh urged the Home Minister to kindly hold an urgent meeting with the representatives of the recognized political parties in J&K on this situation also. He suggested that Govt. of India should hold delimitation of J&K Assembly constituencies by amending any provision imposed by the any earlier government. The Governor of J&K during Governor Rule is competent to amend any law or rule in J&K.

Prof.Bhim Singh said that the delimitation in J&K at par with other states in the country is essential to strengthen National Integration. Delimitation before the poll is necessary to strengthen National Integration.
