Killing of IAF personnel: TADA court frames murder charges against Yasin Malik, others

‘Accused plead not guilty’


Jammu, Mar 16:  TADA Court in Jammu Monday framed charges against incarcerated banned Jammu and Kashmir Liberation Front Chairman, Muhammad Yasin Malik, and other six persons in a case registered against the accused in 1990.

   Presiding Officer TADA Court Subash Chandra Gupta framed the charges against Muhammad Yasin Malik, Ali Muhammad Mir, Manzoor Ahmed Sofi, Javed Ahmed Mir, Muhammad Saleem alias Nanaji, Javed Ahmed Zarger and Shoukat Ahmed Bakshi even as Counsels representing the accused Muhammad Aslam Ghoni and Yogesh Bakshi objected and termed the move as unjustified and uncalled for.

   The charges were framed under Sections 302, 307 Ranbir Penal Code (RPC), Section 3 (3) and Section 4(1) of TADA Act, 1987 and Section 7/27 of Arms Act 1959 read with Section 120- B of RPC in the much publicized Indian Air Force (IAF) personnel killing case. The case was registered 30 years ago.

  Court Correspondent of Kashmir News Trust reported that Yasin Malik, who is languishing in Tihar Jail appeared in the court through Video Conference and he raised many questions with regard to the said case after which the video link was snapped. The other accused pleaded not guilty and said that the charges made against them are fabricated. JKLF (H) Chairman Javaid Ahmed Mir, one of the accused claimed that he had confessed the crime after ‘inhuman interrogation’ he faced. He informed the court that even his father died due to ‘third-degree’ torture he faced under detention in 1990’s.

  Advocate Yogesh Bakshi who respresented the accused said that the court had already made up its mind to frame charges against his clients as media came to know about it before the observation was made. He asked the court how media came to know about it beforehand.

   The Presiding Officer of TADA Court after hearing the arguments observed, “CBI appears to have supported their allegations against the accused, both, by documentary as well as oral evidence.”

  Pertinently, on January 25, 1990, four Indian Air Force personnel including Squadron Leader Ravi Khanna died in a militant attack in Rawalpora area of Srinagar outskirts.

   The court listed the case for next hearing on March 30 this month.

   Meanwhile, the TADA Court also heard the arguments with regard to another case about the abduction of Rubiya Sayed. All the accused inclduing Wajahat Bashir Qureshi, Muhammad Iqbal Ghandro, Muhammad Zaman Mir, Javaid Ahmed Mir and Mehraj Ahmed Sheikh were present.
