Srinagar, July 23: Due to ‘inefficiency’ of Investigation Officer, Court of Anti-Corruption Judge dismissed the Police challan produce by Crime Branch 14 years ago. Anti-Corruption Judge R.N. Wattal said that Crime Branch has failed to prove charges against 3 accused who allegedly committed fraud while Investigation Officer has done investigation in a casual way and the record has not been produced in accordance with the procedure.
The charge sheet according to news agency KNT owes its origin to written complaint addressed to Crime Branch way back in 2001 which reads that one Parvaiz Ahmad Wani was appointed as a Laboratory Assistant on the basis of fake order and his service book was prepared fraudulently.
Preliminary verification was conducted and it came to fore that Parvaiz Ahmad Wani’s application for appointment was recommended by the then Divisional Commissioner Kashmir for his engagement as Laboratory Attendant for 89 days while the then Principal Government Higher Secondary School Nawa Kadal Zainab Andrabi issued appointment order as Lab Assistant in his favour in complete disregard to the recommendations of Divisional Commissioner Kashmir.
The preliminary enquiry culminated into the registration of a formal FIR vide number 41/2001 under section 420, 468, 409, 471, 120- 5(2) PC Act at police Station Crime Branch.
During investigation Statements of witnesses were recorded and relevant record was seized from office of Principal, sent to FSL along-with specimen signatures of accused Principal and his Senior Assistant Farooq Wani and opinion was received that was positive and ivestigation concluded with the prima facie finding that accused Principal Zainab Andrabi hatched a criminal conspiracy with accused Farooq Wani who happened to be the real brother of the beneficiary Parvaiz Wani, issued fraudulent appointment order in the grade of 950-1500 on 30-06-1993 by misusing their official position for their personal benefit, thereby caused loss to Government exchequer.
The challan was produced in the court of law in 2006 and today in 2020, the anti-corruption court dismissed the said challan saying the Crime Branch failed to prove charges and it has done the investigation in an unprofessional manner. KNT
